If the trailer has been repossessed,and if they have proof of service of the notices of repossession and resale that were sent to your husband (the cosigner) if there is a deficiency on the resale, your husband will be obligated to pay it.

It doesn't make any difference if your BIL gets the notices or not, as long as they were sent to the last known legal mailing address.

Your husband can be and most likely will be sued for the deficiency on the resale of the repo. You would be well advised to get the certified letter and a lawyer.
