Thanks for the information.
I recently had a case discontinued against in Bronx County, New York. The case was brought on by First Select. I made discovery request under New York law, and the FDCRA.First Select never complied.
They had a motion for summary judgemnt and I filed a cross-motion for summary judgment because First Select coul not produce an original contract with my signature.
At a hearing on my motion to compel discovery/imposition of sanctions, First Select dropped the case.
Now I have to take on Providian. A local firm has falied to validate me since July of 2003. They send me ofers of settlement and even send me a summons and complaint in Bronx Civil Court (an index number has yet to be purchsed). Is this unfiled summons a violation of the FDCRA? If so what statute?
Can I sue the law firm for violating the FDCRA via a counter claim/cross claim or inplead them as a thrid party defendat??
