I did not know how to bring my previous "stuff" up from 01/21, and appreciate all the replies. However, I am wondering in filing a response and doing so to ask for discovery and proof of claim, am I not going to end up with the original claim, which is about four to five times what they are suing me for? I am thinking they may realize the mistake, and have me for the whole lot, or would they not be able to seek more than the original amount in the suit. I did receive a dunning letter from them, and then the next month, was served. I also think I am within the SOL, as the charge off, from what I can tell on my CR is from 12/2000. Also, I have to add, as this may be the topper, this is my husband's account, and he won't do anything. He says to answer it an settle, and make payments on it. Can I show up and represent him or file the answer on his behalf? We are in GA.
