Depends on what state you live in. This is a small claims issue. When you go before the judge tell him/her that you are having financial difficulties. That you are not refusing to pay, you just don't have the ability to pay. The judge will set up a ppa (partial payment arrangment) - if you live in a garnishment state and the judge allows your wages to be garnished, usually it is only up to 25% per pay period. They can not garnish SSI... most likely the judge will not allow Cap one to add any additional charges...you will be considered a hardsip case
