I originally posted this on 1/23. short version- I have evidently been sued by Credigy for an unpaid credit card (less than 5K)though I have not been officially served. As I have never been sued before, I was curious if anyone might shed any light on what I should expect to happen. Questions- Mainly could I avoid going to court? The rep from Credigy's law firm said she has some time to file a CJO? If I have to appear in court, can I be made to make the full payment to Credigy? Credigy is currently demanding payment in full or at least 1/3 down. I was curious if I have any opportunity to work out a payment plan with them? Should I respond to Credigy in writing, wait to be served or go pick it up at the courthouse? Also, it may be that the last pmt I made was in 1999, and therefore SOL would come into play- should I discuss this with Credigy or wait until a court date? I appreciate the great responses and thanks WHY CHAT.
