Whether or not they can or will take your money from that account without a judgment may depend on your cardholder agreement from the old account.

Some CC issuers that are also branch/transaction banks, state clearly in the agreement that they can seize any funds in their banks if your account is overdue, overlimit, defaulted or closed with a balance.

If I were you, I would choose another bank... quick.
