"why chat" or others- lawsuit filed in GA

Why Chat-

I spoke with an atty regarding the Credigy/Stewart & Assoc lawsuit for my First Union/MBNA/First Select acct. and was told it doesn't appear there has been any violation relative to the additional fees of $600 on top of the original balance.

I don't believe SOL will be viable since I paid MBNA in '02 and the acct. we'll presume was in good standing when purchased from First Union.

I know you are not providing "legal" advice so based on your knowledge/experience, what recourse if any do I have against Credigy and if I do pay them what bearing does that have on my overall credit given they are not the original creditor? bottom line- should I pay them? -wait until served and go to court?

Their offer is either pay in full or 1/3 down then installments.

I still have yet to be served and was told by Stewart & Assoc the Sheriff was looking for me now and a skiptracer was engaged.

I greatly appreciate your help.
