Need response quick.....like....within 24 hrs......please!

Last week, a guy tried contacting my wife about a Discover Card account (got card before we were married in 2000, she is owner of the account, I was only listed as an "authorized user" of the account). I told him that my wife was unavailable so he went ahead and spoke with me. He said they wanted to settle before a judgement was made (please note that the date of last activity is 4/2002, the SOL in Alabama is 3 yrs). The balance is 6055.00, and they would settle for $0.40 on the dollar (2240.00). Of course I told him I couldn't come up with the money. I got his name and number and said I would get back to him (with no intentions to do so).

Well, tonight while I was at work, he called and got in touch with my wife. He told her he wanted to keep us out of court and wanted $900.00 by the 31st. Of course she told him we couldn't come up with that type of money. So he asked how much we could come up with and she blurted out $300.00. So he said he would take $300.00 on the 31st, and $25.00 a month there after.

Ok, here's the questions:

First of all, should I call and have the payment stopped, then call the CA and tell him payment has been stopped and to put everything in writing before the first payment will be made??

2nd: Do I need to make any arrangement at all? SOL runs out in a little over a year. Are there any actions I can take to stall this CA??

3rd: My wife made the mistake of giving our checking account number to him over the phone. Do I need to have the account closed and reopen a new account with a new checking number (with same bank) or change banks all-together?? Being that I was listed as only an authorized user, what if I had a checking account that was only in my name??

4th and final: If they did sue, the only thing we have of any value is a car that is in my name alone, and it's worth only about $750.00. We do not own a home (paying rent) and savings account is empty. Just have a couple of t.v.s and our clothes. Since the account is in my wife's name, will they sue her alone or both of us??
