CAs, other than the willfully retarded, do not sue because they got a C&D. They DO stop harassing you, again, other than the willfully retarded. If CAs can't find any grabbable assets, they don't sue AS A RULE even if they're mad about the C&D. If they do, just pull the Chapter 7 plug. If CAs actually sued as often as they threaten to, every last CA would go broke from paying filing fees because most of the time they can't recover even that much.
