About 6 or more months age, received a letter from a collection atty office stating they were going for a judgment against me from Cross Country Bank and included a filed motion in the mailing. I contacted you guys and was told to answer the motion stating had no knowledge, etc. of debt and to send letter of validation to atty office, which I did. I never received anything from the atty's office and nothing new has been filed in all this time. Last month, I filed a Motion to dismiss with the court stating that I have received no validation, no correspondence, from said law firm. Just received an order putting my motion to dismiss on the calendar in the month of March BUT, the judge has ordered me to serve my motion to dismiss on the atty office (which I did not know I had to do at the time of filing).

Question. I can take my motion and add a certificate of service and file with the court and send to atty office as ordered by the Judge. But am I going to awaken a giant by doing this? I have all the proof that I served all other filings on the attys office and letter of validation, CM RRR, and have heard nothing. Am I in good stance or should I be on the lookout once I serve them with this motion to dismiss. What can they do to me now, without ever validating my debt, anything?? It is still within sol. Thoughts or suggestions anyone, please. Thanks so much.

Linda
