As far as why Cap One did what they did. They are mean. They want to ruin you, because you didn't pay them. Look on all the court sites (saarchable sites) you will see them sue anyone and everyone for as little as $200.

No one should C&D on a debt that is still within staute, IMO. It is an invitation to sue.
