I wrote yesterday (see below)regarding motion to dismiss that I filed and did not serve on the Plaintiff collection atty. Judge sent back order to serve the collection atty and placed my motion on March 29th calendar. You suggested that, since the atty's complaint and summons was sent less than 6 months, to request a withdrawal of my motion. I called clerk and I can do that. However, I just noticed that the above stated Order the Judge signed and sent me placing my motion on calendar and telling me to serve atty was also sent to the atty's office!! Now what do I do. Have I screwed this up beyond any hope. The clerk said I did not have to serve the atty with my request to withdraw since I didn't serve the motion to dismiss to them, but since they have received a copy of what the Judge sent me, what can I now expect. Should I still send the request to withdraw or have I opened Pandora's box. Remember, they never validated or contacted me either prior to the filing of their complaint and summons or since then. PLEASE HELP ME - I'm terrified! Thanks so much.
