Yes file to withdraw, but be prepared to have the CA lawyer re-open.

IF you had legitimate reasons to file your motion to dismiss in the first place, you may be OK. You say you are within SOL, what are you basing it on?When was your last payment to the ORIGINAL creditor while the account was in good standing, (not past due,over limit or late).

Is the "suing" CA still reporting on your reports?
