A "Default Judgement" occurs when a defendent does not answer a summons. If you don't answer, or go to court when required, the Judge will order a default judgement. ALWAYS answer the summons.

In most venues, if the judge grants a default judgement, the defendent usually has 60 days or so to appeal to the court.

After the summons is answered, the Plaintiff may motion for a "Summary Judgement". This will be granted by the court only if the defendant has:
a. Not answered the Plaintiffs interrogatories (Discovery)
b. Admitted to being guilty in his/her response.
c. If the judge feels that the evidence in the Plaintiff's favor is so overwhelming that it would waste the court's time to hear the case.
