A short background. Summer of 2002 my wife was diagnosed with cervical cancer. She endured surgery, chemo & radiation. In November 2002 I was diagnosed with prostate cancer. My cure was surgery in January 2003. Happy ending;we are both survivors. However, we have been in a financial storm ever since due to lost income and increased expences including lingering medical bills regardless of having health insurance.

Before visiting and reading the advice on this site we didn't realize how much control we can have over our situation. We are formulating a plan of action based on our new knowledge. Here are a few questions to start.

If we are sued what does the court take into consideration before establishing a judgement or refusing to do so?

My wife is not employed. We have children who require her to be home. She has two providian accounts which she brought into the marriage. Other than her granting me permission to deal with them concerning her accounts I am not on the accounts. If she decides not to pay the accounts can they sue me as well as her? We live in Florida. I should add that both accounts are currently being paid through a debt counseling service. One has gone from over $6000to about $5400 under a 0% agreement. The other has gone from above to less than $1000 under an 8% agreement.

Can I send a cease and desist letter concerning telephone contact only? I am willing to accept correspondence until we decide who we can and cannot pay.

While the total of our left over medical bills adds up to a few thousand all but one is under $1000 and it is under $1200. My impression from reading the forum is that those items placed with CA will not sue at those levels. Is that probably true? It is the collection of bills that is overwhelmimg.

We have been close to foreclosure on our home and repossession of our vehicle through this. We intend to prioritize our expenses to avoid that type of jeopardy. We just aren't sure of what to expect as some get left behind by necessity.

I have questions concerning some Capital One accounts that have gone to CA but will leave them until next time.
