Call the bank, seeing they beleive you are the account holder, and ask them to send you proof that this account is yours. At some point there has to be a signature on file. Get this signature and, assuming it is indeed not yours, take action on that. This will also get you more proof that it is not yours in your hands if you need to take it to court.
