asked for validation have not received

Alabama is where I live. We have had some problems with fruad on some accounts and some we have not. To make a long story short: We had some money problems and could not pay our credit card debts, at least not all of them. I tried to make a smaller payment on one card, but the guy would not except my payment. So I got to point I could not catch up at all. Well I asked for a debt validation on this card because it seemed higher than what we though it should be, sent certified and all, never received validation, asked again, still no validation. Two months go by, I get a letter from an attorney in Ga. said I have to pay debt in full, sent them notice along with copies of letters and signed validation certified copies.. still no validation was sent to us. Next thing I know, we are summonsed to court by a sheriff through another attorney here in Al. I spoke with an attorney, told us to send back summons along with denial of all charges and reason why (request of validation not received) and send same copies to new acting attorney who filled out request for summons. I did this they signed certified letter ( both attorney and court ) on Dec 9th 2003, it is now Feb 1st, I still have had no response from anyone. Is this legal? Or can I request since it has been over 60 days since since first signed request that this be dismissed? Please help me, we have filed fraud notices with credit companies and even on the net, but we are not sure if this will help us.
