I read on a law firm's website that a firm cannot legally sue you if they reside in a different county. I had disputes with MBNA Visa, who then turned it over to their law firm (Wolpoff & Abramson) who then threatened me and I did all of the typical request for validation, etc., plus I had my own arbitration award against them (even though they ignored it and used National Arbitration Forum to give THEM the award, which I just ignored in return). They then handed my case over to Patenaude & Felix in San Diego who then threatened me to garnish my wages and sieze my assets, etc. Since that time I've responded with an attorney and also some of my own letters with various reasons that they can't get anywhere with me.

Despite their threats they never moved forward and got a judgment against me and it has been over 6 months now. Then a few weeks ago I got a letter saying that they were "for a limited time" willing to settle for less than the full amount. Why would they do this if they truly had me over a barrel? It seems that if they can just go to a judge and get a judgment against me based on their arbitration award they would have done it 6 months ago and gotten the full amount.

Then a week or so ago I got a call saying that I had just till the end of January to settle with them before they try and get a summons to me.

Do you think that I should contact them and try and settle or should I just call their bluff and ignore them? And if they DO summons me can I get it dismissed before the court date?

Also their letters were NOT sent certified mail, but all of my past responses WERE.

I need to make my decision THIS WEEK while I still have time. I think they are bluffing based on the timeframe that has passed and also their willingness to settle with me for a lesser amount.

Thanks,

Hedger
