If you had a good reason for filing the motion to dismiss in the first place, there should be nothing to worry about.

I really do not know what will happen if you withdraw your motion to dismiss, I do not think it is an "admission" that you owe the debt, but it MAY create a problem IF the CA lawyer has ANY evidence that would provide a good case against you.

Your damned if you do, and damned if you don't.
What will happen if you do not file a withdrawal of your motion to dismiss, and do not serve the motion to the CA lawyer, is that you will have your motion denied at the hearing and may be subject to fees. It will also be entered on the case file, and will keep it "alive" for another year.

If you have a GOOD reason for your motion to dismiss, serve it on the CA lawyer, if not, withdraw it.
