Bad Checks, SOL, and Bankruptcy???

As mentioned earlier, checks were written in my name back in 1994 that the creditor is still trying to get me to pay for. In 1996 the creditor says I was summons to court, signed for the summons by certified mail, yet never showed up and as a result the case was DISMISSED FOR WANT OF PROSECUTION. I don't remember signing any papers but that was almost 10 years ago so who knows. Since the creditor attempted to sue me two years after the checks were written but I didn't show up, doesn't this still mean they met the statute of limitations on these checks? Also, when I file for bankruptcy should I include these checks? Although I didn't write them the creditors are still holding me responsible for the debt and trying to get me to pay. Or should I not include them in the BK at all? Thanks Tia
