But you don't have a right to a court trial over contract disputes. You realize that an arbitrator decides a dispute over a contract. If you do not put up your side then how could you win. Then if you loose the arbitration the only way to enforce it is thru the courts. If by using the credit/loan is not an acceptance of the terms ie: agreeing to the possible arbitration, then why not just tell the judge everything that is in Whychat's Letter? If that was the answer then no one would ever loose these cases right?
Because it comes down to Contracts and the laws that govern them. Unfortunatly you do not have the right to a trial in such case. Its a case of resposibility. I understand that when you apply for credit you don't expect not to pay back the loan.
