The NAF will probably rule against you. You should force MBNA to prove you woe the money. You can disclaim that you made those charges, if true, but then you may have to explain why you didn't notify the MBNA earlier of improper charges on your card. They need to prove that the cc account was yours which they maybe able to do if they have the application. You can try and defend by claiming MBNA never provided you any of the amendments to the agreement to force them to show they were mailed to you etc. You can also claim that MBNA needs a live witness able to verify the account etc. and not just submit copies of documents that may be altered etc.

If and when they rule against you, a judgment will be entered that they can take to court to enforce. You cna wait for the outcome of the arbitration before filing BK. After all, you might get lucky and win!
