Chapter 7/Bankruptcy

I am in debt for about $35,000 and am going to file bankruptcy in about 4 months. I lost my job in June 03 and stopped paying creditors about November when my unemployment ended. I haven't use the credit cards since October 03. Do you think I should wait another 6 months or so to file (am going to use We the people) or will they try to sue be before then. Also I haven't talked to creditors, I just don't answer the phone. Two things, I am on my husbands savings account but have my own checking acct. Can they find the savings account and put a freeze on that and if so can I have my name removed from it and say that my husband and I are separated? Before I stop paying them I changed my address to go to my cousins house. By the way I live in Georgia. Thanks in advance
