Most of the ones(Magistrate) I have delt with in the court room have followed the law but also lent a helping hand also. Example: The first two cases I had as a landlord it was VERY easy to see that these two famlies TRASHED!!!! my rental property.(Also owed back rent and balance of rent until I re-rented it). It was short and sweet. I gave pics, contracts, ect... got full amount I ask for. Third case was small amount of back rent $2-3 hundred, and 7-8 hundred in rent on balance of contract until re-rented. The judge started asking me if I sent this and did I do that??? The VERY same things that would have applied in the first two cases. He made sure that JUSTICE was done in ALL THREE cases. The first two he offered NO help to because they deserved NONE! He helped the third because she needed it. You see, when I finally located them and filed, I did'nt know that the POS(piece of s***) husband had took off and left her and two small children and had not paid any child support. She was also very timid in to court. He awarded me about 250.00 and at the last second I dismissed so it would not go on her record. Later on the Judge (he is also a "friend") told me thanks that I did the right thing.
But this is a SMALL claims (magistrate) judge who is NOT an attorney. ( In Ga. to be a Magistrate Judge you don't have to be anything but popular!)
I guess it will DEPEND on the judge. BUT!!! they will not rule in a way that is against the law as long as the defense is brought up! That is why I love this place, because regular folks like me can find out what the LAW is and THAT is their DEFENSE!
