Tell them that the lawsuit is time barred and if they do not dismiss with predujice within 72 hours you will be filing a counter claim against asset AND the attorney for willfully and maliciously pursuing a time barred lawsuit.

If they give you any sh*t, tell the attorney that you look forward to seeing him in front of a United States District Court jury. And oh yeah, you'll be happy to let the state bar know what is up too.
