I "DID" EARNESTLY try to work it out with them in MITIGATION...I was willing to accept $200 per month PLUS anything over his $1100 take home pay (he works on commission)...I came about with this offer based on his $1049 take home check (I wasn't even considering his wife's paycheck...it already was spent due to two garnishments from other people)and he said he could do it, I was even willing to allow the $51 increase to an even $1100, BUT, after TWO HOURS,when I tried to tack on specific dates that he would be paying me, all of a sudden,HE (not I) said...WE're taking this to court. He had INITIALLY stated in front of the mediator as well as myself, that he had already cleared it with his boss that the boss was to take out $150 and mail it directly to me, so when we finally came to an agreement of the $200 plus anything over the $1100, the defendant agreed to it...it was when I told the mediator that I wanted the terms of the agreement to include the dates that the payments would be sent to me, that the MEDIATOR asked him if he could get the information and the defendant said he could, then the MEDIATOR asked if he could call him, the defendent said "yes" and the MEDIATOR said, ok, let's go call him NOW. At that point is when the defendant got nervous, but complied and when he and the Mediator re-entered the room, the defendant was very angry, hit the table with his fists and forearms and said WE ARE GOING TO GO TO COURT...that leads me to wonder if he was being truthful about his agreement to have his boss (of three months mind you)send payments to me.I have a SIGNED CONTRACT with them that they will pay me $543 per month over a period of 8 months. I obtained this on the LAST DAY of their children's attendance. I was not letting them use my services without their payments. They had been making payments...SOME $500, some smaller...Eventually, his wife confided in me that she suspected he was gambling again and when I found out that he was gambling with my money, as well as others, I asked HER to please pay me...she did her best to try, but then they stopped (one month past) and that was when I told them they had to remove their children from my daycare. By this time, he was also being evicted from their home, lost his car, lost their Rent-to-own furniture and failed to pay other bills (utilities).When it came time to pay me the contractual agreement (Novemeber 1, 2003), they said they were only able to pay me $200 per month. That means to me now instead of being paid off in the allotted 8 months of out contractual agreement, it would now take "over" TWO YEARS. I have ALL my documents and contracts and PROOF to win my judgement, and as of our courtdate set at the end of February, I know I will win (they do not deny they owe me), I just want to know what where I can find ALL the information I can on WAGE GARNISHMENTS and HOW much I can expect to get...I know I have made a drastic mistake (stupid if you will) in keeping them here in my daycare, but I have had their children for over 7 years and for the most part, though they would get behind, they would at least eventually get caught up. I appreciate YOURS and ANYONE ELSES input and help in this situation...THANK YOU
