You have my gratitude, Why Chat. That is exactly what I needed to know, because the first late month was 7/98 or 8/98, more than five years + one month before the lawsuit was filed. The next payment was 12/98, but I have that bill and it shows that the account was still in arrears by ~$600 and continued to accrue late charges until 3/99. No more payments were ever made to the account and I had no contact with the original creditor or the CA, but the OC and the CA re-aged the debt to 4/2001 on my credit report. My guess is that is when Midland purchased or was assigned the account, because they were not the originally assigned CA.

I've been in the same location for over five years and the OC knew where I was, so I'm thinking of asserting another affirmative defense of laches.

I feel much better now. :-)
