Yes, and thus intent would be proven if you stopped payment without a good reason. The only good reason to stop payment on a check is if you are protecting your rights under the law. And yes, you had better be sure you are in the right or the other party can seek damages. To get criminal penalties however intent to defraud would have to be proven.
