I am not an attorney but as I understand it Discovery is the process wherby the Plaintiff, and the Defendant ask questions by either interrogatoreis (written ???) or by depositions
(in person interviews usually with court recorders present to record the ??s and answers) Also I think discovery includes the Production of Documents requests. Both the Plaintiff and the Defendant have the right to Discovery.
If I understand your earlier posts you asked for Valadation. The FDCPA position is that if you ask for Valadation, all further debt collection action must cease untill such time as proper valadation is received. I think there is some ? as to weather or not a Plaintiff can initiate a law suit during this period (where valadation has not been provided) but for sure all collection activity must cease including any further action in the litigation process. In other words they may be aloud to file a law suit (not sure on that) but if they do, a continuation of that process is a violation of the FDCPA.
I you are sued you must answer the law suit or you will lose by default.
