As JK already noted, if you were insolvent at the time the debt was 'cancelled', then you do NOT have to claim that 36K as income. Its the year the debt was cancelled, NOT the year the 1099 was ISSUED that mattters here.

What dates did the scumbags at MBNA put on the 1099 ??

For insolvency, you need form 982.
