DEMAND FOR PRODUCTION OF ORIGINAL NOTE


According to the provisions of the Federal Fair Debt Collections Act, the creditor, in order to legally and lawfully validate the purported debt, must produce the original note establishing jurisdiction in order to collect the debt. The assumed debtor has the right to demand production of said original note in the original condition it was, when he/she signed said note.

The assumed creditor’s signature gives validity-legality-verification to the note. If the original note has been altered in any way it becomes an invalid note. If it is endorsed, stamped, reconstructed, signed, altered, attached, etc., if altered in any form or fashion, it is no longer a valid legal note and the creditor cannot legally collect nor can a Third Party Debt Collector pursue payment of the Note.

The creditor has neither legal standing nor any legal jurisdiction to enforce collection of a purported debt that has been altered or changed in any way. These are all legal protections given to the people via the Federal Law - The Fair Debt Collection Practices Act - The U. S. Code title is 1692 et seq.

The assumed debtor has a legal right of inspection of the original note. In most all cases of inspection of the note and any of its attachments, the inspection will confirm the creditor has already been paid and the debt has been satisfied. The debtor is being charged for the debt from a third party whom the creditor has illegally sold the original note without the knowledge, consent or contract of the debtor. This is criminal conversion and a commercial crime against the signer of the note.

I do hereby demand that you produce the original note for this purported debt for my personal review and inspection. Please include any attachments to the note and all agreements signed by me and your authorized agent.

I require compliance with the terms and conditions of this demand letter within 30 days, or a complete withdrawal, in writing, of any claim.

In the event of noncompliance, I reserve the right to file charges and/or complaints with appropriate County, State & Federal authorities, the BBB and State Bar associations for violations of the FDCPA, FCRA, and Federal and State statutes on fraudulent extortion.

I also hereby reserve my right to take private civil action against you to recover damages.
