They can file it, but it is not enforceable. I believe Tx has the same rules as Fl.
If you go to sell,or refi, you have to file a form ( good for 180 days in Fl) called an afadavit of homestead. This is filed with the deed or mortgage to protect the title.

It is always possible that a homesteaded property could become assailable if you move out of the area and rent the house out, or perhaps under other circumstances like divorce where you might no longer have homestead exemption.
