You don't need an attorney - you need our Scott - resident SCAMCO killer ;) Unfortunately, I believe he's on vacation. SOL in CA is FOUR YEARS, so if your last payment on the old account was 1999 or before, the SOL has expired and SCAMCO is S.O.L. !! Couple of things to do if Scott isn't back yet. 1 - Go to WhyChat's web site (see "NEWCOMERS" thread below) and get a copy of the NOTIFICATION OF SOL C&D LETTER there. The CA statute you need is on that same site. Send the letter certified, RRR and hang on to all copies of the green card and the letter. That should stop them from bugging you. 2 - CA has some GREAT consumer laws so file a complaint with your Atty General's office ASAP. I believe in CA its illegal for them to even ATTEMPT to collect on an SOL debt ! 3 - Call the FTC, or go to their website (www.ftc.gov) and file a complaint with them. Be very specific - they are watching SCUMCO. 4 - File a complaint with the IL Atty General - that's where these scammers operate from so make sure your compliant goes in. 5 - Check your credit reports. They can NOT do anything to put this old debt back on your reports and if they do you should sue their butts off !! They can NOT do ANYTHING to you and you do NOT have to pay them a thing. Don't talk to any of them on the phone - let them talk to your machine until they get you C&D letter. After that - log any and all calls or correspondence you get from them as each one is a violation of the FDCPA and you have more fodder for a lawsuit.
