A creditor isn't going to care if you state you are judgement-proof in a letter. In fact, there isn't such a thing. You can be sued and receive a judgement regardless of your financial situation. You may be 'enforcement' proof, since there is no way to enforce the judgement. The creditor, lawyer, or CA makes that determination on their own with facts and figures. They may very well know you don't have assets and sue you simply because that is the policy of the company. If you are 'judgement proof' then you can take some comfort in knowing that you will lose nothing if they get a judgement. In the meantime, answer if you are sued, request validation, whatever you can. But basically writing that type of letter will help you as much as telling them on the phone that you can't pay. THEY DON'T CARE.
