just my experiences with doin this. a few posts have mentioned this and i want to say..BK is for when one needs it. it is not a way to simply avoid what u owe. i know our judge in san angelo, texas, examined things very carefully. what had we bought in the past 6 months to a year? what KIND of 401k we had, as some can be accessed. it is not something to just "stick" assets in somewhere and think u may get by with it. be really careful..how u go about it...its a federal law with federal judges. they dont take kindly to someone just thinkin to get away with something. ie: the poster who was gonna buy a fancy car..make sure ur retirement cant be touched..some can. also for a year later had we won the lottery or came into money..it would have gone to satisfy the BK. this is why u need a lawyer for this. its very complicated. just my view!
