BK questions

Hello,

After a divorce I've analyzed my financial situation and believe a Chap 7 BK is in order. I already have one lawsuit pending against me by one creditor, and to pay all my debts w/ my current disposable income would take over 10 years.

Some questions. I've been thinking of filing myself. I have no real estate or real property (I rent an apartment) and only $39 in a 401(k). I have a vehicle loan, but am listed as the cobuyer on the contract. My personal property comes in pretty close to my state's (Tennessee) exemptions. So, is this wise (to file myself)? I can't really afford an attorney.

Also, I have one credit card I use occasionally, but I don't carry a balance -- I pay it off every month. Would this still be seen as fraud? The items I've used it for are pretty much neccessities -- gas, food, etc. There might be a couple of "leisure" items on there, but they don't amount to more than $50.

Finally, having pulled my credit reports before I file (to make sure I get all my creditors), I see some old credit cards from years ago that are still open (but have 0 balances). I haven't used them in years, and don't even have the cards anymore. Do I still need to list them?

Thanks,
Gerbil
