Capital One (law firm Hosto & Buchan)

Has anyone ever dealt with Hosto & Buchan (out of Arkansas) and their representation of Capital One? They started sending us notices about a year ago on a Capital One account. We have been sending something every month and have gotten the balance under $700 (started out at around $1,500), however, due to unexpected expenses we could not send them money this month, and they were not sympathetic (even though we had been making substantial payments all along and never missed) -- we are within the SOL for our state which is why we have been paying -- the question is how likely are they to sue and if they sue and get a judgment how much will the balance increase? I would hate to see a $700 balance triple. Another question: if I am sued and take the balance owed to court to satisfy the debt does that dismiss the case? My thought is that by the time they got around to suing, serving me and the court date I would probably be able to scrape together the amount owed.
