Get rid of the collection agency first. Send them packing and then worry about the statute of limitations.
That's easy to do and also get the bad reports off of your credit bureau files. That's not hard to do either.
The collection agency isn't going to do one single solitary thing but cause you a lot of grief. So get rid of them and then worry about the rest.

: My wife has been contacted by a collection agency about
: a debt to the VA for school benefits she last received
: in 1991. Her 1992 thru 1994 tax refund was garneshed to
: pay off this debit. When the feds did not garnish her
: 1995 tax refund she assumed the debit was paid. Now
: this collection agency syas she owes $3900.00 dollars.
: She thought her original debt was around $1600. She
: had $1150 garneshed from her tax refunds. I found the
: state debt limits, but what are the federal limits on
: debt and judgements? We will pay any remaining amount
: owed (she thought it was paid off) but not any interest
: or penalties since no one told her she owed any more
: money.

: Thank for any info-Scott
