I signed a gym membership in 1995; I quit paying on it in 1996 or 1997 (can't remember). I was under the impression that it was charged off, but it has NEVER shown on my credit report. I recently got a letter for about three times the original amount from a CA. This is the first communication I have received on this debt in at least 7 years, maybe closer to 8. The SOL in Missouri is 10 years on written contracts. I am planning to send a validation letter. I have two questions: 1. Since this has not been on my credit report, can the CA start reporting now and start the SOL over? 2. I made the mistake of calling them because I thought it was another debt that I had from this gym that I cancelled, and that they couldn't collect. They informed me on the phone (but of course, not in writing) that the debt was charged off in 1996 and that they just acquired the debt in Dec. 2003. What should my next move be? Also, if it helps, I filed BK 7 in 1997, but the case was dismissed. None of my other creditors have tried to collect.
