The lawsuit was for a repoed car, I did included in my BK, but I got my discharged after the default judgment.
So what happened was that th plaintiff lawyer filed in court a suggestion of BK under my name at the time of the summary judgment (my bk case was not discharged at that time, and legally they had to stpo any legal proccess against meincluded in my BK petition)
Now that my BK is discharged, the lawsuit is on hold until further order by the court, and my ex got a summary judgment.
I called my BK lawyer and the secretary told me that I should send a copy of the discharge to the plaintif of the lawsuit and request my name to be taken out of the case.
Is that possible???
My BK closed in december, and I went to see the court records for the lawsuit and ther is no copy of my discharge BK. It only says, order to hold until further notice.
Should I send a copy of my discharge to the plaintiff or to the judge?
Is there any legal process to get my name out of a case since it was declared in my BK?
