Tape the phone calls and present them at trial. Have your son swear out an affidavit or testify personally in court. If you can afford it, transcribed the telephone conversation and have it notarized and present at trail. If your son can't go to court take the affidavit.

The clerks at small claims court are a big help. Remember we, as a Texas residents, have justice of the peace courts. Very low filing fees.

I am taking a few weeks off when my wife has our baby (approx Mar 27th) and I will be testing the waters myself in JP court.

Most CAs will not hire an attorney for JP and small claims courts, so I am hoping for default judgements. I will be asking for summary judgments as I have tape and transcribed telephone calls and have sworn affidavits on talking to others. It will be nice to turn the tables.
