Both of you need to read Kimber vs Federated Financial. It's the lawsuit Why Chat references. It's long but, well thought out. The judge touches on many issues but does find that the threat or actual filing of a lawsuit beyond the SOL is an FDCPA violation and, BOTH the collection agency and the lawyer are liable.
