Death Row is FULL of people who went there on "your word against theirs" evidence. It's all in who the jury wants to believe. Give it a try sometime and see if a good upstanding citizen gets laughed out of the building, or if the judge throws the book at the obviously full-of-crap CA. IF and only IF the CA even answers the complaint--some don't bother, and get defaulted. Others will call up to settle the day after they get served with process.

Of course, recordings always help where legal, but they are not necessary. Sworn testimony IS evidence.
