If account is SOL, send SOL letter, available from this site. Make sure you refer to the debt as 'alleged'. Admit to nothing, do not sign the letter, best not to tempt those gifted in the art of forgery.
Don't understand what you mean when you say get a judgement then sue them. You sue and if successful, you get a judgement.
You are not protected by SOL. SOL is an affirmative defense if, when sued, you file it with your answer. Weapons only protect you if you use them.
CA's file time-barred illegal suits on SOL debt all the time and win default judgements. Why? Easy money.
As far as suing first, always best not to be seen as litigious. Discourage these punks from suing by sending the SOL letter, and filing FTC complaint stating they are threatening to sue on SOL debt. Nice way to get their attention.
The one who files first is seen as, if you will, throwing a party. If the going gets rough, the court views first filer as a poor host. Example is the way you answer a suit to the first filer.
He must state his counts, or causes for action, on his initial papers. You as defendant have the right to answer "lack knowledge", shorthand for saying; "Look jerkxxx, this is your party, you invited me against my will, by force of law, backed by the man with the gun, so you cater it already, you big flatulent fatso.
Another way of putting it, Florida is lightning capital of the world. The bolt that blasts home appliances and tv sets to smithereeens is not the first bolt, or 'feeler stroke', but what is called 'the return stroke'. That's the second, and fatal shot of Joules.
Let CA pig-plops be the feeler strokes. You are the return stroke.

In an family mattter of this unworthy scribe, our family's rather substantial estate was conned from an elderly relative, his spouse cleverly 'poisoned' so as to remove an obstacle to the assets. The perps are a 'crazy relative who did things in the attic', the invariable crooked nancy-boy lawyer, a prominent medical school whose President lies. In writing. Not smart. Good for us, too bad for them, and of course, everyone's fave, a cute, cuddly, corrupt HMO.
This cabal of crooks has been for several years beside themselves. Why? Because of facts discovered which have been placed on file with interested agencies. They are frightened to death each time a letter issuing forth from this wretched wordsmith finds its mark. Too bad. They made a decision to exploit the elderly. They can jolly well forget their prominent state positions. They'll be assuimg new ones in the big house. That's what happens to those who add insult to injury. Shower call.
Among many professionals reviewing this matter who are certified to speak to various areas of concern, many note with interest that your humble correspondent has not been sued for defamation by them, given what has been published in hope all will see their error and turn around. While time yet remains.
Said professionals note the obvious answer: To sue would ensure their doom. They'd have to prove defamation, which they cannot and never will. Truth is a fine defense to the charge, you see. Also, their suit opens the door to discovery by the defendant. And they absolutely dread any further discovery and publication beyond what has already greased the skids for their eventual fall from 'grace'.
Let bullies one and all take the first through Nth shots. Make sure you take the last.
