If a CA sics an attorney on you after you have asked for validation IS continued collection activity, and a violation of the FDCPA. A creditor never HAS to validate, they just have to cease collection attempts until they do. So, many will just sell the account and wash their hands of you and the trouble of validating. This is NOT a violation - you just have to start over with validation with the next thug in line.
