Heather, you unfortunately are dealing with CA's who will, as youve noticed, lie until they're blue in the face if it will extract even a penny out of you. I have to agree with WhyChat and everyone else here that says "IGNORE THEM" but, for an answer to your question. There is a Federal Rule of Evidence that applies to things (settlement conversations) like this. Federal Rule of Evidence #408 specifically dictates that settlement offers and the like ARE NOT and CANNOT be used to evidence that you are claiming any responsibility to a debt. So, if you intend to write any letters in reference to a settlement offer, write in bold letters at the top......FRE 408 APPLIES......and you will be fine.
