I disagree Kelly-- if their credit reports are showing a 5 year old + account as paid as agreed, then they do NOT want to trade that for a BK OR a chargeoff.

I suggest a "good will" letter to Wauchovia,explaining the circumstances and stating that you are having problems with their changing the agreement that was made as to the due dates and interest, and ask if these changes are in conformity with the Va banking statutes and consumer credit laws and the TILA.

If you have OTHER credit cards that defaulted, this likely will not work too well, but if you have managed to keep your credit in good shape, don't blow it now.
