Discover will forward you file to an attorney. This could take a month or so. The attorney will send several letters to incite you to settle before they file a lawsuit. This will delay everything another 3-6 months depending on how patient the attorney is and if they believe that they will get a settlement without having to sue.

If they file a lawsuit, they will have to hire a process server to serve you the summons. This could take a week or two depending on how motivated the server is.

After the summons is served it will be forwarded to the county court, and a court date will be set. This is another 3 months in most areas. This is usually just a pre-trial and gives you and the plaintiff time to exchange discovery (interrogatories). The real court date will be another 3 months or so after the Pre-trial.

Things are different everywhere, but I think it's safe to say that if Discover still has the file you won't go to court for the better part of a year.
