When they went for their motion for summary judgement. One of the things they said was that there were no material issues of fact. So far, I have denied knowledge of the debt but have not produced any evidence on my part to confirm that this is the case (that I do not owe).

Am I required to produce evidence saying that I do not owe ? If I don't can the judge then assume that I owe and require me to pay up regardless of SOL ?

I guess my question is : Which is the stronger legal principle ? SOL or the fact that I cannot prove my claim that I do not owe ?

Thanks for your advice about the court reporter.
