Sounds like you got the standard boiler plate letter Discover sends out. They go from nice to nasty at the drop of a hat. If Discover still has your file, call them to work out an arrangement to bring it up to date. They have been known to sue more than other creditors. However, if Discover has your acct (and it sounds like it may have already been charged off), or if you realistically can bring it current, then lay low and out of sight. Like the other people said, suing won't happen overnight. And even then, typically creditors only sue if they think they can get something out of you. You should OPT-OUT and get a credit report on yourself to see what the creditors can see about you. Do you have assets such as a house or boat they can attach? Does it show current employer info? Do you live in a state where they can attach wages? Does your state have a homestead exemption? Are you paying your other creditors according to the credit report? Can they easily locate you? Do you have tax liens on your credit report. All of these questions are factors that go into whether or not to sue you. Keep in mind that CAs are lazy and want to go for the easy targets first. Also, once you receive the initial letter from the CA, don't request validation. The reason for this has been discussed here before. Try a search on this one.
